The cap no longer makes sense now that we group by type, and there isn't a civ with 20 different types of units to fill up the GUI.

Remove the cap completely, and we'll see how that goes for the next release.

I agree this limit should be removed. I think of it like this: say you have a huge number of units (on screen), perhaps in the hundreds. It's annoying if the game starts lagging when you select them all, but this can likely be improved by modifying the simulation-GUI interface for selections. On the other hand, it's far more annoying IMO if you can only select an arbitrary N units at once (currently 64) so it would take as long or longer to sort your units out anyway.

And don't forget population limits which will make it unlikely that hundreds of units could be selected at once anyway.
